Why Use an Attorney/Mediator?
By education, training and experience, attorney/mediators regularly engage in problem solving, explore creative solutions, and explore compromise alternatives.
Attorney/mediators are skilled at narrowing and defining the issues and analyzing the consequences of various alternatives, including tax ramifications and the problems that may be encountered in implementing and enforcing agreements.
Attorney/mediators are trained to look at both sides of an issue and can remain neutral, favoring neither party at the expense of the other.
Attorney/mediators can draft complex agreements that accurately express the intentions of the parties.
An attorney/mediator can work effectively with the individual attorneys representing each party.
Although attorney/mediators do not represent either party, they can utilize their knowledge and experience to help educate the parties with respect to the law and practice applicable to a particular situation, keeping in mind that a mediator cannot give legal advice to the parties and that the parties cannot take the mediator’s comments, suggestions or opinions as legal advice, but must rely on the advice and counsel of their respective attorneys.
MEDIATOR PROFILE AND RESUME
David S. Goldberg, Esq., has practiced law in Maryland since 1967, with a heavy concentration in family and divorce law. He is a 1963 graduate of the University of Maryland and received his law degree in 1966 from Georgetown University Law Center. He is a member of the Maryland State and Montgomery County Bar Associations, and is licensed to practice law in all state and Federal courts in Maryland and D.C. including the United States Tax Court and the Supreme Court of the United States.
Mr. Goldberg has the highest Martindale-Hubbell rating, AV - Preeminent, for ethical standards and for professional ability (legal knowledge, analytical capabilities, judgment, communication ability, and legal experience) based upon evaluations submitted by his fellow lawyers and by members of the judiciary.
